Welcome to my portfolio. These Terms and Conditions govern your use of this website and outline the foundational principles of how we do business together. By browsing this site or reaching out to start a project, you agree to these terms. I believe in plain language and honest communication, so I have kept this as clear and straightforward as possible.

1. General Use of the Website

  • The Content: All text, layouts, images, and custom designs on this website are my intellectual property unless otherwise stated. You may not scrape, copy, or repurpose my portfolio work or code for your own commercial use without permission.

  • Accuracy: I strive to keep all information, including service descriptions, accurate and up to date. However, the digital landscape moves fast, and I reserve the right to update or change the content on this site at any time.

2. Starting a Project

  • Initial Discussions: Reaching out via a contact form or email does not bind either of us to a working relationship. A project officially begins only when a formal proposal is accepted and a project-specific contract is signed.

  • The Service Agreement: The specific details of your build—including timelines, deliverables, scope, and specific technical requirements—will be mapped out in a dedicated, plain-language contract sent via Dropbox Sign. In the event of any conflict between these general website terms and your signed service agreement, the signed agreement takes priority.

3. Financial Terms & Payments

  • Invoicing: All official quotes and invoices are managed and issued securely through Zoho.

  • Deposits: I do not begin design or development work on a blank canvas without a secured deposit. The deposit percentage secures your spot in my production schedule and covers initial strategy and structural work. Deposits are non-refundable once work has commenced.

  • International & Local Payments: For South African clients, standard EFTs are required. For international clients, payments are securely processed via Wise to manage currency conversions efficiently.

  • Final Delivery: The final website, custom assets, and domain transfers (if applicable) will only be handed over or published live once the final project invoice has been settled in full.

4. Intellectual Property & Ownership

  • Your Ownership: Once a project is completed and fully paid for, you own the final website, the content you provided, and the digital assets created specifically for your brand.

  • My Rights: I retain the right to showcase the completed project (including screenshots, links, and performance metrics) on this website and across my professional channels as part of my design portfolio.

5. Liability and Limitations

  • Performance: I build high-performance, intentionally designed websites. However, I cannot guarantee specific financial returns, search engine rankings, or business growth metrics, as these depend heavily on your ongoing marketing efforts and market conditions.

  • Third-Party Tools: If your website relies on third-party platforms (like CMS databases, payment gateways, or booking systems), I am not liable for any downtime, data breaches, or operational failures caused by those external services.

  • Maximum Liability: To the maximum extent permitted by South African law, my liability for any claim arising out of our working relationship is strictly limited to the total amount you paid for the specific web design services in question.

6. Governing Law

These terms, and any contracts we enter into, are governed by the laws of the Republic of South Africa. Any disputes will be handled in South African jurisdictions, though my primary goal is always to resolve issues collaboratively and fairly before they ever reach that point.
